Modification of Terms and Conditions of Use
Pctown Computers Ltd reserves the right to amend any of the terms and conditions at our discretion. You are responsible for regularly reviewing these terms and conditions.
Terms Used
"Product" refers to the goods and/or services supplied by Pctown Computers Ltd.
"Purchaser" refers to any legal entity purchasing goods and/or services from Pctown Computers Ltd.
Acceptance
By placing the order for goods through Pctown Computers Ltd or by leaving purchaser's computer or any other items to Pctown Computers Ltd for servicing, you are deemed to accept the terms and conditions of sale.
Payment Terms
All prices shown on the website are in NZ$ and include GST, but exclude freight fee. Purchaser is required to provide an order number as a reference when making a payment.
Shipping and Risk
Pctown Computers Ltd shall only deliver products after received the payment for ordered products. Shipping cost should be paid by purchaser for delivery of the products.
Risk (including insurance responsibility) shall pass to the purchaser on collection of the products by the purchaser or on the delivery by a carrier to the purchaser.
Liability for shortages in the quantity of products delivered is limited to making up the shortages. A claim for shortages, defects or damage must be made in writing within three days of receipt of the product. Purchaser should provide a reasonable opportunity for Pctown Computers Ltd to investigate the claim. If purchasers found that there is a shortage or visible damage to outer packaging, the carrier's note must be endorsed, so the claim for damage or loss in transit could be made against the carrier.
The delivery times are estimated to be 1-4 working days. Any quotations of delivery times by Pctown Computers Ltd are made in good faith but are estimates and it shall not be bound by such quotation.
Return and Cancellation Policies
Pctown Computers Ltd may, but is not obliged to, accept the return of any product that was ordered and correctly supplied. All returns have to be approved by Pctown Computers Ltd and are subject to a minimum 20% restocking fee. Returns must be within 7 days of purchase and in saleable condition with complete packaging and contents. Software cannot be returned. Shipping charges will not be refunded.
Any variation, waiver or cancellation of the purchaser's order shall have no effect unless accepted in writing by Pctown Computers Ltd.
The prices and availabilities may be revised at anytime without notification. Purchaser can choose to cancel the order if an increasing price notification is sent to purchaser by Pctown Computers Ltd. Pctown Computers Ltd cannot guarantee that all products ordered by purchasers are available due to administration, stock control mistakes or other causes. Pctown Computers Ltd will email purchaser as soon as possible to notify the unavailability of certain products.
Guarantees
The Consumer Guarantees Act 1993 ("the Act"):
1. The Act shall not apply where the purchaser is acquiring the product for the purpose of business.
2. While the purchaser is acquiring the product for purposes other than that of a business, then these conditions of sale shall be subject to the purchaser's rights under the Act.
Manufacturer or importer of the products and Pctown Computers Ltd do not undertake that repair facilities and spare parts will be available for the products.
Any damage of products caused by purchaser from misuse, accident, incorrect or careless installation, improper operation, adjustment and using the products far more often than a reasonable consumer would expect to use the products will not be covered by warranty.
The original invoice will be requested for all warranty claims. Please see warranty page for reference of warranty.
Limitation of Liability
Pctown Computers Ltd will not be liable for any consequential loss when the product is used for business. The total aggregate liability of Pctown Computers Ltd is limited to the amount paid by purchaser for the products in such case.
Purchaser has full control and knowledge of information, data and software stored on the System and will be responsible for such information, data and software and their use, including, but not limited to, installed 3rd-party software, all of the user's personal setting preferences, contents and backup files. Pctown Computers Ltd will not be liable for any loss for failure to realize expected backup.
Purchaser acknowledges that Pctown Computers Ltd has been requested to perform repair work or other services that may destroy some or all data files, settings and software stored on purchaser’s System. In the events of any data, files and software being erased or damaged during repair work or other services, neither Pctown Computers Ltd nor its employees will be held responsible.
Errors & Omission & Modifications
Pctown Computers Ltd is entitled at any time to correct all errors and in any product description, quotation, invoice or acknowledgement. The information provided by this website is subject to change without notice. While every effort has been made to ensure accuracy, Pctown Computers Ltd will not be liable for any inaccuracies in the information contained herein, except where provided for by the consumer guarantees act.
Website transmission cannot be guaranteed to be secure or error-free as information could be intercepted, corrupted, lost, destroyed, arrive late or incomplete. Product image is an approximate guide only.
Web links are provided for your convenience, product information and pricing found via web links may not apply to products available for purchase in New Zealand.
Property Ownership
Ownership of all products sold by Pctown Computers Ltd is retained by the seller until full payment is received for all amounts owing in respect of all goods supplied.
Service
All repaired items must be picked up by the purchaser within 60 days from the date of repair. Pctown Computers Ltd will dispose of items at its discretion after the said date.
